TERMS AND CONDITIONS OF SERVICE OF C&R MEDICAL CARRIER

ACCEPTANCE OF TERMS
By scheduling or using medical transportation services from C&R Medical Carrier LLC (“Company,” “we,” “our,” or “us”), you (“Client,” “Patient,” “you,” or “your”) agree to be bound by these Terms and Conditions. If you do not agree with these terms, do not use our services.
These Terms and Conditions govern all medical transportation services, including medication delivery, hospital transfer services, medical appointment transportation, and discharge services provided throughout New Jersey and surrounding areas.
SERVICE DESCRIPTION
Medical Transportation Services: C&R Medical Carrier provides non-emergency medical transportation (NEMT) services including:
- Medication delivery with temperature-controlled transport
- Hospital and facility transfer services
- Medical appointment transportation
- Discharge transportation from healthcare facilities
- Wheelchair-accessible and stretcher-equipped transport
- Medical equipment and supply delivery
Service Limitations: Our services are for non-emergency medical transportation only. We do NOT provide:
- Emergency ambulance services requiring sirens or lights
- Advanced life support or continuous medical monitoring
- Transportation for unstable patients requiring emergency care
- Medical advice, diagnosis, or treatment
- Home healthcare or personal care services beyond transportation
For medical emergencies, always call 911.
SCHEDULING AND RESERVATIONS
Booking Services: Services may be scheduled by phone at 267-309-8672, through our website booking form, or by authorized healthcare facilities on behalf of patients. We recommend scheduling at least 24-48 hours in advance when possible, though same-day service may be available.
Confirmation: All service requests are subject to confirmation based on vehicle and driver availability. We will provide confirmation of scheduled services, including pickup time, estimated arrival, and any special instructions.
Service Changes: We reserve the right to modify pickup times within a reasonable window due to traffic, weather, or other unforeseen circumstances. We will notify you promptly of any significant changes.
CANCELLATION AND RESCHEDULING POLICY
Cancellation by Client:
- More than 24 hours notice: No cancellation fee; full refund or free rescheduling
- 6-24 hours notice: May incur a minimal rescheduling fee
- Less than 6 hours notice: 50% cancellation fee applies
- No-show: Full service charge applies
Exceptions: Cancellation fees are waived for medical emergencies requiring hospitalization, doctor-initiated cancellations, or weather/safety concerns preventing safe transport.
Cancellation by Company: We reserve the right to cancel services due to unsafe weather conditions, vehicle mechanical issues, driver illness, or other circumstances beyond our control. You will receive full refund of any prepayment.
PAYMENT TERMS
Fees and Charges: Service fees are based on distance, service type, wait time, special equipment needs, and urgency. We provide upfront quotes before confirming service. Fees include:
- Base service fee
- Mileage charges
- Wait time (after first 30 minutes)
- Special handling fees (temperature control, stretcher, etc.)
- After-hours or holiday surcharges when applicable
Payment Methods: We accept cash, credit/debit cards, insurance assignment, and electronic payment methods. Payment is due at time of service unless other arrangements are made.
Insurance: For clients using insurance coverage, we will verify benefits and obtain prior authorization when required. You are responsible for co-payments, deductibles, and any services not covered by your insurance plan. We will bill your insurance as a courtesy, but you remain ultimately responsible for payment.
Late Payment: Accounts not paid within 30 days may incur late fees and may be sent to collections. You are responsible for all collection costs including attorney fees.
CLIENT RESPONSIBILITIES
Accurate Information: You must provide accurate information including medical conditions affecting safe transport, mobility limitations, medication requirements, pickup/destination addresses, and insurance information.
Readiness for Pickup: You must be ready at the designated pickup location at the scheduled time. Extended wait times beyond 15 minutes may result in additional charges or service cancellation with applicable fees.
Behavior Standards: Clients and accompanying persons must:
- Treat drivers and staff with respect
- Refrain from violent, threatening, or abusive behavior
- Not be under the influence of non-prescribed drugs or alcohol
- Follow driver instructions regarding safety and vehicle rules
- Not smoke or vape in vehicles
- Not damage company property
Prohibited Items: Weapons, illegal substances, or hazardous materials are strictly prohibited in our vehicles.
Right to Refuse Service: We reserve the right to refuse or discontinue service to clients who violate these terms, pose safety risks, or engage in abusive behavior toward staff.
MEDICATION DELIVERY TERMS
Authorization: Medication delivery requires proper authorization from the patient or legally authorized representative. For controlled substances, valid photo ID must be presented at delivery.
Pharmacy Coordination: We coordinate with your designated pharmacy for prescription pickup. Delays due to pharmacy issues (medication not ready, insurance problems, etc.) are beyond our control.
Temperature-Sensitive Medications: We follow FDA and New Jersey Board of Pharmacy requirements for temperature-controlled transport. Temperature monitoring data is maintained for regulatory compliance.
Delivery Confirmation: Signature confirmation is required for all medication deliveries. Controlled substances require hand-to-hand delivery with ID verification—no leave-at-door option.
LIMITATION OF LIABILITY
To the Maximum Extent Permitted by Law:
The Company’s total liability for any claim arising from our services shall not exceed the amount paid for the specific service giving rise to the claim.
We are not liable for:
- Missed appointments due to circumstances beyond our control (traffic, weather, road closures)
- Delays caused by client readiness or facility discharge timing
- Pharmacy delays affecting medication delivery timing
- Medical complications unrelated to transportation services
- Lost or stolen items not directly caused by driver negligence
- Consequential, indirect, or punitive damages
Medical Disclaimer: Our drivers are trained in CPR and first aid but are not medical professionals. We do not provide medical advice, diagnosis, or treatment. Any medical emergency during transport will result in immediate contact with emergency services.
Vehicle Insurance: We maintain appropriate commercial vehicle insurance and liability coverage as required by New Jersey law. Our insurance information is available upon request.
HIPAA COMPLIANCE
We are required to comply with HIPAA regulations protecting your health information. Our Privacy Policy and HIPAA Notice of Privacy Practices describes how we collect, use, and disclose protected health information. By using our services, you authorize us to share necessary health information with healthcare providers, insurance companies, and others involved in your care as described in our Privacy Policy.
INDEMNIFICATION
You agree to indemnify and hold harmless C&R Medical Carrier LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:
- Your violation of these Terms and Conditions
- Your violation of any law or regulation
- False information you provide
- Your negligence or willful misconduct
- Claims by third parties arising from your use of our services
DISPUTE RESOLUTION
Governing Law: These Terms and Conditions are governed by the laws of the State of New Jersey without regard to conflict of law principles.
Arbitration: Any dispute arising from these terms or our services shall be resolved through binding arbitration in Burlington County, New Jersey, in accordance with the rules of the American Arbitration Association. You waive the right to participate in class action lawsuits.
Exceptions: Either party may seek injunctive relief in court for violations of intellectual property rights or confidentiality obligations.
FORCE MAJEURE
We are not liable for failure to perform services due to circumstances beyond our reasonable control including acts of God, natural disasters, severe weather, pandemic, government orders, civil unrest, strikes, or other force majeure events.
SEVERABILITY
If any provision of these Terms and Conditions is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
ENTIRE AGREEMENT
These Terms and Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and C&R Medical Carrier LLC regarding our services.
MODIFICATIONS
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on our website with the updated effective date. Continued use of our services after changes constitutes acceptance of modified terms.
